These terms govern your use of thaiear.com, the ThaiEar Android app, and the version of the site you can install to your device's home screen (together, "ThaiEar"), operated by ThaiEar ("we", "us"), a trading name of Toby Ralph, a sole trader. Our business address is 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London W1T 6EB. By using ThaiEar or creating an account you agree to these terms. If you do not agree, please don't use the service.
ThaiEar provides Thai-language learning material in three parts:
With an account you can also build playlists, take the quizzes, track your listening, and download material to use offline. We may add, change or remove content and features at any time.
You can read the sentences, translations and glosses, and work through the Read Thai course material, without an account.
You need a free account, created by signing in with Google, to play any audio, take the quizzes, take the Read Thai tests, build playlists, track your progress, or download for offline use.
You're responsible for activity under your account and for keeping access to your Google account secure. Please don't share your account with anyone else.
You must be 18 or over to use ThaiEar. It is not directed at children, and we don't knowingly provide it to anyone under 18.
We'll send you service messages about your account and your subscription. Email updates are optional — you choose whether to receive them from your account page, and you can unsubscribe there or from any update email.
We decide which topics are free and which are premium, and we may change that at any time: a topic that is free today may become premium, and the reverse. We may also grant complimentary or lifetime access at our discretion, and withdraw it. Where we grant "lifetime" access, that means for as long as we continue to operate the service.
Premium is a recurring subscription billed monthly at the price shown at checkout (currently £6.99/month), processed by Stripe. It renews automatically each period until you cancel. We may change the price with reasonable notice; changes apply from your next billing period.
You can cancel any time from your account page (Cancel membership); access continues until the end of the period you've already paid for, and you won't be charged again. Refunds are governed by our Refund & Cancellation Policy.
Cancelling is not the same as deleting your account — see section 6.
You can delete your account at any time from your account page. Deleting takes effect immediately. It:
We don't refund the unused part of a period ended this way, and we can't restore a deleted account. If what you want is simply to stop being billed, cancel instead (section 5) — your access then continues to the end of the period you've paid for.
Your access is for your own personal, non-commercial study.
You may use the offline download feature in the app or the installed site, and — where we have enabled it for your account — the desktop MP3 download, to keep copies for your own listening on your own devices. Section 8 covers both.

Any copy you have made is licensed to you personally, and that licence ends when your membership ends.
Downloading is available in the Android app and in the installed version of the site. It isn't available in an ordinary browser tab.
Offline downloads are a convenience, not a guarantee. They depend on your device's storage and on your browser or operating system keeping them, and either can clear them at any time without warning. The app also re-checks your membership from time to time; if it can't reach us for an extended period, downloaded premium audio stops playing until you reconnect. We don't guarantee that any download stays available or playable, and you shouldn't treat one as your only copy.
The desktop MP3 download is enabled for individual accounts at our discretion, and can be withdrawn. A file it produces sits on your own computer, outside the service, so we can't remove or update it — if a recording is later replaced, your copy won't change.
Playlists you build, and the progress and listening statistics we show you, are stored with your account. You choose your playlist names and your display name; please keep them lawful, and don't put anything in them you wouldn't want us to see if you contact support. We may remove content that breaches these terms.
Your quiz scores and your Read Thai test results are stored with your account, so they follow you to any device you sign in on. Results recorded while you are offline are kept on that device and sent to your account the next time you reconnect.
We don't guarantee that saved work lasts indefinitely. Please keep your own record of anything you'd miss.
These terms cover the ThaiEar Android app and the installable version of the site as well as the website. The Android app is distributed through Google Play, and Google's own terms apply to your download and use of it from that store.
Subscriptions are bought on our website and billed by us through Stripe. They are not Google Play purchases, so Google Play's refund and subscription-management tools don't apply to them — manage yours from your ThaiEar account page.
All content on ThaiEar (sentences, recordings, design) is owned by us or our licensors and is protected by law. You receive a limited, personal, non-transferable licence to use it within the service; no other rights are granted.
ThaiEar's content is provided for general language-learning purposes only. While we take care in preparing it, we make no representations or warranties about the accuracy, completeness or reliability of any sentence, translation, audio recording or other information on the site, and we accept no responsibility for it. Language usage varies by region, register and context; our material is not a substitute for instruction from a qualified teacher or a professional translation. You rely on the content at your own discretion and risk, and we don't guarantee any particular learning result.
Our Thai audio is recorded by native Thai speakers. The English translations are produced using speech synthesis, and we may change how any particular recording is produced. No recording is perfect: a word may be mispronounced or a pause misplaced, and the paragraph above applies to audio as much as to text.
We aim to keep the service available but do not guarantee that it will be uninterrupted, error-free, or free of viruses or other harmful components. We may suspend, withdraw or restrict all or part of the service for maintenance, technical or operational reasons, and we are not liable for any resulting unavailability.
The service relies on third parties — for sign-in, payments, accounts and data storage, hosting and content delivery, audio hosting, and email. The current list is in our Privacy Policy. We are not responsible for the acts, omissions, availability or content of these third parties, and your use of them may be subject to their own terms.
The service and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
To the maximum extent permitted by law, we accept no liability for any loss or damage — whether direct, indirect, incidental, special or consequential, and including loss of data, profit, goodwill or opportunity — arising out of or in connection with your use of, or inability to use, the service or its content.
Nothing in these terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any of your statutory rights as a consumer that cannot be excluded under applicable law. Where our liability cannot be excluded but can be limited, it is limited to the total amount you paid us in the 12 months before the claim arose.
We may update these terms from time to time. We'll post the revised version here with a new "last updated" date; material changes take effect from posting or, where required, with reasonable notice. Continuing to use the service after changes means you accept them.
If a change materially reduces what a paid subscription includes, or increases its price, we'll tell you by email in advance and you'll be able to cancel before it takes effect.
We may suspend or close accounts that breach these terms. You can stop using the service at any time; sections 5 and 6 cover cancelling and deleting your account.
These terms are governed by the laws of England and Wales, and disputes are subject to its courts. This does not remove consumer-protection rights you have where you live.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be applied to the maximum extent permitted by law.
